Badly Worded Conditions

When not written correctly, conditions are a Settlement Agent’s worst nightmare. Here are some handy hints on writing special conditions to make sure it answers the following questions:

  • What is the condition about? Be specific.
  • When does the condition need to be met?
  • Who needs to arrange for it to be done and who pays?
  • If the condition is not met to the satisfaction of the buyer, what are the consequences?

To avoid any complications, all clauses must state these simple steps when writing a special condition on a contract: 

  • What is the clause for? i.e., White Ant Certificate, Building Report, etc. 
  • Who pays for the inspection or service (if required)? 
  • When does the condition need to be met? 
  • If the condition is not met, what are the consequences?
